Artikel ilmiah ini membahas tantangan yang dihadapi oleh debitur pengganti selama proses asumsi pinjaman rumah, yang memerlukan pengaturan rahasia untuk mengalihkan tanggung jawab pembayaran kredit dari debitur pertama. Terlepas dari pemenuhan kewajiban kredit, debitur penerus mengalami hambatan dalam mengamankan sertifikat rumah, yang terus didaftarkan dengan nama debitur pertama, yang disebabkan oleh pelaksanaan prosedur administrasi yang diperlukan oleh bank yang tidak memadai. Melalui analisis komprehensif undang-undang terkait, termasuk Undang-Undang Hak Ketergantungan, Undang-Undang Perbankan, dan Peraturan Bank Indonesia, dalam hubungannya dengan Teori Perjanjian dan Teori Keadilan, artikel ini mengeval_uasi hambatan hukum yang muncul dan mengusulkan rekomendasi yang bertujuan untuk meningkatkan protokol pengalihan sertifikat rumah untuk menumbuhkan kepastian hukum dan kesetaraan bagi debitur pengganti. Rekomendasi tersebut mencakup peningkatan transparansi bank dalam proses administrasi, penguatan pengawasan mengenai perjanjian informal, dan peran penting lembaga terkait untuk memastikan bahwa hak debitur pengganti atas rumah, yang pembayaran kreditnya telah diselesaikan, dapat diperoleh tanpa halangan.References
