MEKANISME PENETAPAN EKSISTENSI HAK ULAYAT SEBAGAI DASAR PENGAKUAN NEGARA

One of the obligations of the state in a legal state is to regulate land rights to ensure legal certainty and provide legal protection for every citizen, including customary law communities that have customary rights. The existence of customary rights of customary law communities in Indonesia is recognized in the constitution and other laws and regulations. However, for these customary rights to gain recognition from the state, there is an administrative mechanism that must be fulfilled by the customary law communities as regulated in the legislation. The mechanism for establishing the existence of customary land rights as the basis for state recognition is the main topic to be discussed in this research. This research is a normative legal study using library research methods for data collection. The data obtained is analyzed qualitatively and presented descriptively. The results of the study indicate that the mechanisms that must be fulfilled to obtain state recognition of the existence of customary land rights include: a) the administrative stage, and b) the registration stage.References
